1. GENERAL RULES

1. Definitions:

• Organizer – ADB Tomasz Kośmider, NIP 6371810647, tel. 799-014-683, email: contact@floworbiter.com
• Ordering Party – a person or entity registering for training, also the payer of the training
• Participant – a person directly using or referred to training
• Course – training, course organized remotely

2. These regulations define the rules of participation in the course organized by ADB Tomasz Kośmider, NIP 6371810647
3. Information on services offered by ADB Tomasz Kośmider constitutes an invitation to conclude an agreement within the meaning of art. 71 of the Civil Code.
4. Confirmation of registration by the Ordering Party means conclusion of an agreement between the Ordering Party and ADB Tomasz Kośmider, the subject of which is the provision of a service consisting in participation in an online course.
5. By registering, the Ordering Party agrees to be contacted by phone and e-mail by the course coordinator, designated by the Organizer, in organizational matters concerning the course.
6. The prices of the Trainings indicated on the website are gross prices and include VAT. Prices for consumers with whom the agreement is concluded in the territory of the Republic of Poland are given in Polish zloty.

2. REGISTER FOR TRAINING

1. Registration for participation in training is understood as:

• The Ordering Party fills out the online form on the website www.floworbiter.com
• The Ordering Party sends the application by e-mail to contact@floworbiter.com

2. Confirmation of the application for training is:

• The Organizer confirms the Ordering Party’s participation in the training by e-mail to the address indicated in the form within 2 business days from the date of receipt of the application
• The Organizer may contact the Ordering Party by phone if it needs to clarify the details

3. The order of applications determines participation in the training.
4. Correct submission of the application is tantamount to the Ordering Party’s acceptance of these Regulations.

3. PAYMENT TERMS

1. Individuals are required to pay 100% of the course fee by bank transfer at least 5 business days before the first day of the Course.
2. In the case of payments made by bank transfer before the start of the Course, please provide proof of the transfer immediately
3. Other entities are required to pay 100% of the course fee + VAT based on the VAT invoice issued by the Organizer after the end of the training. The fee must be paid within 7 days from the date of issue of the VAT invoice.
4. In the event that the training organized by ADB Tomasz Kośmider does not take place on the planned date or in the event of a lack of places on a given date, the amounts paid for the training will be refunded within 5 business days from the information about the impossibility of conducting the course.

4. WITHDRAWAL FROM PARTICIPATION IN TRAINING

1. You can cancel your course reservation free of charge no later than 7 days before the course starts.
2. In the event of withdrawal from the training for 6 days or less, the Ordering Party is obliged to pay a fee constituting 100% of the price of the classes based on a VAT invoice issued after the end of the classes.
3. Information about withdrawal from the training must be in writing under penalty of nullity and may be sent by letter or in the form of a scan/photo by e-mail.

5. ORGANIZATIONAL NOTES

1. The Organizer reserves the right to change the date or cancel the training no later than 3 days before the start of the training. Registered Participants of the training will immediately receive a proposal for another training date and can use it by transferring the reservation. Otherwise, they will receive a full refund of the amount paid for the training. The Organizer is not responsible for any costs incurred by the participant (e.g. booking accommodation, travel tickets, etc.).
2. The Organizer reserves the right to change the trainer while maintaining the substantive level and program scope of the training.
3. The training materials given to participants of the classes are protected by copyright. Copying and disseminating them is prohibited.
4. The recording of the course or training by the participant, using devices or software recording sound or image and sound, as well as dissemination of their content is prohibited.
5. The Organizer of the training reserves the right to record (in audio and/or video form) the training.
6. The Organizer is not responsible for any disruptions, including interruptions, in the functioning of the selected online meeting platform caused by force majeure, unauthorized actions of third parties or incompatibility of the platform with the IT infrastructure of the Ordering Party.
7. The Organiser has no control over the content of third party websites that may be linked and is not liable for any loss or damage that may arise from a Participant’s use of such third party websites. Any third party websites that Participants decide to access do so at their own risk.

6. PERSONAL DATA PROCESSING

1. By sending the training registration form or application form, the ordering party consents to the placement and processing of personal data contained in the form by ADB Tomasz Kośmider, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the Act of 18 July 2002 on the provision of services by electronic means (i.e. of 15 October 2013, Journal of Laws of 2013, item 1422) for purposes related to the implementation of the service. In the event that personal data of course participants other than the Ordering Party are indicated on the Form, the Ordering Party undertakes to obtain the consent of these participants to the placement and administration of their personal data by ADB Tomasz Kośmider to the extent indicated above.

7. FINAL PROVISIONS

1. In matters not regulated by these Regulations, decisions are made by the Organizer.
2. The Organizer reserves the right to introduce changes to these Regulations.
3. Any disputes arising in connection with the implementation of training in the case of Clients who are not consumers within the meaning of Polish law will be resolved by a common court with jurisdiction over the registered office of ADB Tomasz Kośmider, NIP 637-18-10647, Wrocław
4. Each Participant declares that they have read and accepted these Regulations.
5. The above Regulations are effective from December 10, 2023.
